Thats a load balancer issue. If apache isnt responding to health checks I would
say the tool is doing the right thing. What state are all the apache child
processes in and what state the apache master. Do other web servers like
thttpd show the same problem in your setup ?

No wake one code was added to the kernel. No kernel does health checks at
kernel level.
