I think I do...

1. GPL says "Source must be made available."
2. Source is not available on Internet.
3. What happens if you ask the guy nicely?

If you can get the code that way, which seems to be the most likely situation,
no problem. If not, then there is a problem until the source returns to the
Net, which seems to be soon. In the worst case, the non-compliance is
temporary.
